Craig Burgess successfully defended a local dentist against malpractice claims asserted in Poughkeepsie Town Court. The plaintiff alleged that the local dentist provided “botched” and unnecessary dental work. The defense argued that the plaintiff presented with advanced global periodontal disease, as well as pre-existing bone and tooth loss requiring extraction and implantation. It was further argued that before this could be done, the plaintiff required scaling and root planing, as well as antibiotic therapy. Ultimately, on the day of the Hearing the presiding Judge dismissed the case with prejudice after the defense established that plaintiff failed to present adequate expert testimony to prove that the dentist deviated from good practice and/or caused any injury to the plaintiff.
